Neighbourhood survey

Neighbourhood survey is the most widely used and oldest method of investigation information.

It allows you to spread a folder, verify and cross-check information. The Neighbourhood Investigation is the ultimate recourse of the private investigator who will act face-to-face and without usurping a quality.

What the law says !

Neighbourhood survey can have several purposes is :

  • they may relate to a need for information (proof of subletting, search for a person)
  • they are also diligent when one has a recurring problem with neighbors this will result in neighborhood disturbance.

Neighbourhood disturbance is defined either by incessant noises (music, barking, work, recurrent screams, etc.) or by olfactory nuisances (smells).

Originally, a disturbance of the neighbourhood was based in Article 1240 of the Civil Code, which states that “Any fact of man, which causes harm to others, obliges the one through whose fault he has managed to repair it.”

Article 1241 of the Civil Code, which also states that “Everyone is responsible for the damage he has caused not only by his doing, but also by his negligence or carelessness.”

We subsequently enlightened the issue through the case law, in a founding judgment of the abnormal disturbances in the neighbourhood issued by the Civil Chamber of the Court of Cassation on 27 November 1844 and subsequently in a judgment of the Second Civil Chamber of the Court of Cassation on 19 November 1986 which assumes that ” no one should cause an abnormal neighbourhood disorder to others »

In addition, Section R. 1334-31 of the Public Health Code defines neighbourhood disorders and therefore states that “No particular noise shall, by its duration, repetition or intensity, impair the tranquillity of the neighbourhood or the health of the man, in a public or private place, whether a person is the originator or whether through a person, something in his care or an animal under his responsibility. ».
