What the law says in sub-lease !!

Subletting is the act of subletting a dwelling, that is, renting it to someone while you are a tenant yourself. The latter is regulated by tenants and is accepted under certain conditions.

According to the law, the subletting of an empty dwelling is prohibited bysection 8 of the Act of 6 July 1989 which states that ” the tenant cannot give up the tenancy agreement or sublet the unit except with the written agreement of the landlord, including the price of the rent. The rent per square metre of living space in the sublet premises cannot exceed that paid by the principal tenant. The tenant sends the subtenant the landlord’s written permission and a copy of the current lease.

In the event of termination of the main contract, the subtenant cannot avail himself of any right against the lessor or any title of occupancy.”

In this case, the landlord must have written agreement to sublet and agreement on the price of rent for the subtenant. This request is usually made by registered mail with notice of receipt or through a judicial officer.

The exception of this law applies to furnished apartments that can freely sublet if there is no clause in the landlord’s agreement and if the lease was signed before March 27, 2014. If these two cumulative conditions are not met then the ALUR Act imposes on furnished tenancy the same terms as empty dwellings, the above article.

This law ALUR of March 24, 2014 extends the scope of the July 6, 1989 law regulating residential leases to furnished tenancy, which it defines in section 25-4, which states that it is a ” decent housing equipped with sufficient furniture and quality to allow the tenant to sleep, eat and live properly in accord with the demands of everyday life ».
